Privacy Policy

株式会社commissure (“we”, “us”) sets out below its privacy policy (the “Policy”) regarding the handling of users’ personal information in the services provided on this website (the “Service”).
Article 1. Personal information
“Personal information” means personal information as defined in the Act on the Protection of Personal Information: information relating to a living individual that can identify a specific individual by name, date of birth, address, telephone number, contact details or other description contained in that information, together with information that can identify a specific individual on its own (personal identification codes), such as data on facial appearance, fingerprints or voiceprints, and the insurer number on a health insurance card.
Article 2. How we collect personal information
We may ask for personal information such as name, date of birth, address, telephone number, email address, bank account number, credit card number and driving licence number when a user registers to use the Service. We may also collect transaction records and payment information containing a user’s personal information, arising between the user and our business partners, from those partners (including information providers, advertisers and advertising distributors; the “Partners”).
Article 3. Purposes of collecting and using personal information
We collect and use personal information for the following purposes.
- 1. To provide and operate our services.
- 2. To respond to enquiries from users (including verifying their identity).
- 3. To send email about new features, updates and campaigns for the services a user is using, and about other services we provide.
- 4. To contact users as necessary, for example about maintenance or important notices.
- 5. To identify users who have breached the terms of use, or who attempt to use the Service for improper or unlawful purposes, and to refuse them access.
- 6. To allow users to view, change or delete their own registered information and to view their usage.
- 7. To bill users for paid services.
- 8. Purposes incidental to the purposes above.
Article 4. Changes to the purposes of use
- 1. We will change the purposes of use of personal information only where the change is reasonably deemed to be related to the purposes before the change.
- 2. Where a purpose of use has been changed, we will notify users of the changed purpose, or publish it on this website, by the means we determine.
Article 5. Provision of personal information to third parties
1. Except in the cases listed below, we will not provide personal information to third parties without obtaining the user’s prior consent, save where permitted under the Act on the Protection of Personal Information or other laws and regulations.
- (i) Where it is necessary to protect a person’s life, body or property and it is difficult to obtain the individual’s consent.
- (ii) Where it is particularly necessary to improve public health or promote the sound growth of children and it is difficult to obtain the individual’s consent.
- (iii) Where it is necessary to cooperate with a national government body, a local government or a party commissioned by them in carrying out affairs prescribed by law, and obtaining the individual’s consent risks impeding those affairs.
- (iv) Where we have given notice of, or published, the following matters in advance and have filed notification with the Personal Information Protection Commission.
- (a) That provision to third parties is included in the purposes of use.
- (b) The categories of data to be provided to third parties.
- (c) The means or method of provision to third parties.
- (d) That provision of personal information to third parties will be stopped at the individual’s request.
- (e) How such requests are received.
2. Notwithstanding the preceding paragraph, the recipient is not treated as a third party in the following cases.
- (i) Where we entrust all or part of the handling of personal information within the scope necessary to achieve the purposes of use.
- (ii) Where personal information is provided in connection with a business succession following a merger or other cause.
- (iii) Where personal information is used jointly with specified parties, and the individual has been notified in advance, or the information has been placed in a state where the individual can readily know it, of that fact together with the categories of personal information used jointly, the scope of the parties using it jointly, their purposes of use, and the name of the party responsible for managing that personal information.
Article 6. Disclosure of personal information
1. Where an individual requests disclosure of their personal information, we will disclose it to them without delay. However, if disclosure would fall under any of the following, we may withhold all or part of it, and where we decide not to disclose, we will notify the individual without delay. A fee of 1,000 yen per request applies to the disclosure of personal information.
- (i) Where disclosure risks harming the life, body, property or other rights and interests of the individual or a third party.
- (ii) Where disclosure risks seriously impeding the proper conduct of our business.
- (iii) Where disclosure would otherwise breach laws or regulations.
2. Notwithstanding the preceding paragraph, we will not, as a rule, disclose information other than personal information, such as history or attribute information.
Article 7. Correction and deletion of personal information
- 1. Where the personal information we hold about a user is incorrect, the user may request that we correct, add to or delete it (“correction etc.”), following the procedure we prescribe.
- 2. Where we receive such a request and determine that it should be met, we will carry out the correction etc. of that personal information without delay.
- 3. Where we have carried out a correction etc. under the preceding paragraph, or have decided not to do so, we will notify the user without delay.
Article 8. Suspension of use of personal information
- 1. Where an individual requests that use of their personal information be suspended or that it be erased (“suspension etc.”), on the grounds that it is being handled beyond the scope of the purposes of use or that it was obtained by improper means, we will carry out the necessary investigation without delay.
- 2. Where, based on the results of that investigation, we determine that the request should be met, we will carry out the suspension etc. of that personal information without delay.
- 3. Where we have carried out a suspension etc. under the preceding paragraph, or have decided not to do so, we will notify the user without delay.
- 4. Notwithstanding the preceding two paragraphs, where a suspension etc. would involve substantial expense or is otherwise difficult to carry out, and an alternative measure necessary to protect the user’s rights and interests can be taken, we will take that alternative measure.
Article 9. Changes to this privacy policy
The contents of this Policy may be changed without notice to users, except in respect of laws and regulations and matters otherwise provided for in this Policy.
Unless we provide otherwise, the amended privacy policy takes effect from the time it is posted on this website.
